Health Hackathon Terms and Conditions

By registering for and participating in the Hackathon, the entrants:

  • Warrant that: their entry is original; that the entry and resources used to create the entry are solely that of the entrant(s) submitting them; that the entrant owns any intellectual property rights in the entry or have all necessary rights or licences to use them and submit the entry in the Hackathon; that, to the best of their knowledge, their entry does not infringe any intellectual property rights of any third party; and that any current employer and/or learning institution which the entrant is employed by or enrolled with would have no claim to the entry developed and submitted.

  • Indemnify the University of Auckland against all claims, demands, actions, costs, expenses (including but not limited to legal costs and disbursements on a solicitor and client basis), losses and damages arising from or incurred by reason of any infringement or alleged infringement (including but not limited to the defence of such alleged infringement) of any intellectual property rights in respect of the entry or otherwise in respect to their entry, creation of the entry, participation of the entry in the Hackathons or use or misuse of prize money.

  • By participating in the Hackathon, acknowledge they will be disclosing and demonstrating their entry to other entrants of the Hackathon and the judging panel. This disclosure is a public disclosure and may impact the entrant’s ability to protect their intellectual property rights by way of patents. Entrants must ensure they are comfortable sharing any information and ideas in this way.

  • Accept that all intellectual property rights in the entry shall remain vested in the entrant(s) who created them or, in the case of intellectual property rights owned by any third party or parties, such third party or parties. The University of Auckland accepts no liability for any disagreement among team members regarding ownership of any intellectual property rights contained in any entry including, without limitation, the winning entry or for any inaccurate or incorrect information supplied or relied upon by any entrant during the Hackathon.

  • Licence the intellectual property rights, including in any code or APIs under an appropriately open license that allows reuse, commercial use, remixing and redistribution. As the owner of the code, entrants can of course fork that code and commercialise, but to be eligible for the competition the codebase and demonstration submitted must be open source. All other content must be available under a Creative Commons Attribution License. The reason for the open licensing of code and content is because the Health Hackathon is about useful outcomes that anyone can use and build on.

  • Agrees that the University of Auckland may use the  entrant’s name and photo in connection with the publication and promotion of the Hackathon and the University of Auckland. The entrant shall cooperate with all reasonable requests to promote the Hackathon. No financial compensation will be paid for cooperation of the entrant in promotional activities.

  • Agrees the University of Auckland shall not be liable for any costs, losses and/or damages resulting from or in connection with (i) participation in the Hackathon or (ii) any damage to or loss of entrant’s personal property or to any computers or other hardware, data or software, that the entrant may use or bring to the Hackathon.
